• Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
• Website refers to Voiaje, accessible from https://www.voiaje.com

Upon termination, Your right to use the Service will cease immediately.

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven’t purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

In countries where exclusion or limitations of liability are allowed, The Company and its affiliates will not be liable for:

I. Any indirect, special, incidental, punitive, exemplary, or consequential damages, or
ii. Any loss of use, data or business regardless of legal theory.

These exclusions or limitations will apply regardless of whether or not The Company or any of its affiliates has been warned of the possibility of such damages.

The Company is not Liable to you for any loss of documents, trip interruptions or cancellations and is not
responsible for the conduct, whether online or offline, of any user of our services.

All content of The company ( graphic, text, images, video, design, advertising, compilation and all other material) including and without limitation The Service “feel and look” are protected under copyrights and other proprietary rights not limited to IP and are property of Voiaje or its licensors. It is prohibited to copy, rearrange, redistribute, modify directly or indirectly any such matters or part of the Service as well as remove or alteration of advertising.

The Company is not responsible and does not review content of any sites linked to its service nor endorse it. You connecting to any other site or service is at your sole risk and you agree to the disclosure of these sites and acknowledge advertisement and that The Company is not responsible for such content.

The Company requires that You register and set up an account to use all of the Services. You may be provided, or required to choose, a password, first name, last name, user ID, email, and/or we may ask for other user information. You agree and represent that all User Information provided by you is accurate and up-to-date. We may refuse, at our discretion, to grant you a username that impersonates someone else, is protected by trademark or other proprietary right law, or is offensive.

Upon Account registration and set up, You are solely responsible to keep Your Information confidential and for any failure in doing so. All services used by you or anyone you grant access will be under your sole responsibility. It is forbidden to assign, sell, transfer your user information and this agreement to any third party without a written approval from The Company. It will be considered information breach of this agreement and any attempt to do so will be terminated and void 

You must immediately change the Your Information and contact The Company at info@voiaje.com if you have a reason to believe that your account is no longer secure  (e.g., loss, theft or unauthorized disclosure or use of Your Information or Device used to access the Service),

By accepting to receive messages or any communications from the service directly to your device, you are fully responsible for keeping services updated with your current phone number. The Company is not responsible for any information sent to a device from our outdated phone number. Any software installation you do or if you allow any service that stores information from the Voiaje service on any of the device you are responsible to remove your information or disable access to such software or service in order to prevent unauthorized access to your information account.

You are solely responsible for all content shared, uploaded and published such as pdf documents, text, notes and other content. We are not responsible for the content shared and uploaded via the Service. You may not upload, share, copy or download content unless you have the permission to do so. The Company understands that you retain all rights and intellectual property to your content including copyright, trademark, privacy, publicity or other personal or proprietary rights. You understand that The Company may remove Your content on its Service, at its sole discretion, if it violates any law or is offensive. You recognizes its responsibility for all of its content’s backup.

By posting Your content, You grant permission to The company for the right to store and access all content. This permission extends to trusted third parties The Company works with. You may remove Your Content from the Service at any time.

 

Feedback

When you provide The Company  with feedback, suggestions, testimonials, comments, ideas, ratings, reviews, bug reports or any related information, you agree that this information becomes the exclusive property of The Company.

The company may use comments or feedback without any obligation, compensation or consent from you. If you do not agree with these terms regarding Feedback, or want to maintain ownership of any intellectual property contained in any specific Feedback, your sole recourse is to not submit such specific Feedback to The Company.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Company nor any of the company’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
